I finally got the letters and the root cause of my I485 denial. My previous employer informed that they used my approved I140 for another employee. As many of you might know this I140 substitution practice was a loophole until June 2007. These days companies can not do this any more.
So probably when my I485 came up for adjudication, there was no I140 since it had been used and hence they denied it. Now, I changed jobs per AC21 rules--yeah the famous rule that USCIS ignores. I am waiting on my current attorneys to file an MTR as soon as possible.
Question to forum members:
1. Are there folks in EXACTLY similar situation?
2. If yes, after filing MTR and it getting accepted, what are next steps since one definitely needs a approved I140?
3. Further to #2 above, does one need to file another I140 and port the previous date? I am sure this would take longer time than the current H1b that I hold until June 2009.
4. Can any one share lawyer name and contact info who might have favorably helped a forum member so that I can contact the person and get a second opinion to discuss legal strategies that might be available.

As SKIL Bill is in both house (Congress & Senate), couple of co-sponsers/strong supporters in both house and probably easy to convince Senators/Congressmen compared to CIR, I am wondering what is IV's strategy (QGA) to push this bill?

My wife and I got involved with IV activities/volunteering about 2 months before the rally....and we are very glad we did!
Its been a very rewarding and learning experience....after meeting with the lawmakers- it has fortified our belief in IV and renewed our enthusiasm about the process. After reading Logiclife's post I am convinced that active participation is the key to achieving success!
We plan on continuing our efforts - turning sceptics into believers - it is especially needed in the DC/VA/MD!

I've the same question. If I complete an online Masters in info tech from a reputed university, with the SKIL bill, can I jump the queue?
Will a part time MBA / executive MBA from reputed university do any trick for the existing H1b holders? I am not asking this for GC, but it is mere co-incidence with SKIL bill and my intention of doing MBA.
The very first para in August 2006 visa bulletin says...
This bulletin summarizes the availability of immigrant numbers during August. Consular officers are required to report to the Department of State documentarily qualified applicants for numerically limited visas; the Bureau of Citizenship and Immigration Services in the Department of Homeland Security reports applicants for adjustment of status. Allocations were made, to the extent possible under the numerical limitations, for the demand received by July 10th in the chronological order of the reported priority dates.
MY COMMENTS:
In may it was Apr'08, then it was Apr'15 and now it is again Apr'01. So when the dates are in April 15, more people have applied for 485(than I have imagined) to consume the VISA availability quota. I wonder, if those many people are there from 2001 April and before to consume the quota, then when will the datel move to May'01. Forget about the visa dates moving to July/Aug/..Dec 01.
If the SKIL bill or any other provision is not passed into the law, it is always better to have a secondary plan to save the career at least. It is better to think our family and career assuming what we will be doing if the priority dates does not cross Dec'01 in the next five years.
I personally think to move back to India if I do not see anything by march next year. Already I am in the end of seventh year. If the SKIL bill is not passed, I donot want to do a MBA here by spending 40K(partime ,100K fulltime) and then doing a sr.software er job. With the spagetti law, I cannot change my roles whatever qualifications I add after applying for my GC. i would not recommend either murthy or R khanna i had a lousy exp with R Khanna and a friend of mine with murthy. I love Fragomen (my Co uses them) my last company i used Thomas Fan (based in MD) I like them both.

Also note, the attendance at short notice for the SJ rally was phenomenal.
Let's just say Californians are more motivated and active then many from the DC area, and you can expect an even larger crowd the next time around, with better planning and more time imo.

Most people showing their cool wisdom still not getting the point. A BEC person with Feb 2005 PD may not be able to file for another 2 years while a PD 2007 person will be enjoying EAD during that time. In my dictionary this is injustice. And that's why i was kinda happy when they updated the July bulletin, now I'm not really happy even if my company has already filed my 485/EAD on july 2. I'm still wishing (and i'll be honest) USCIS come up with a reason/regulation/rule that will delay EAD for everyone until BEC people are able to file 485 OR in Oct they retrogress only till March 2005.
P.S. if you are superstitious, you want to know this: most of my relatives/freinds call me "Black Tongue" because usually when i say something unpleasent it happens. e.g. i told my wife last month that i don't believe everyone is able to file 485, something will go wrong and everyone will be disappointed. (when everyone expects something it does not happen- contrarian theory)

All law firms hired by the employer will only respond or react to employer and not to the employee. Fragomen is very conservative (not 100% ethical) and will not take any chances with GC processing. Employers will always take the law firm's adivice because they dont want to take any risk either. Fragomen represent almost all of the fortune 100 companies, all of BIG4's, BIG 3's and all major consulting firms.
If you (personally) hire Fragomen directly they will respond to all your queries in timely fashion. You will not talk to the lawyer at all. You will only talk to the paralegal. This is the problem with all big law firms.
Again, the prestige of the law firm you hire does not have anything do with your application.

That Effective date is the one you are refering to. Introduction date is when the bill was added to the senate calander.

Very good. If I can go, I am sure you can go too. If I can afford to buy some plane tickets, you can too. If I can take a day off, you can do it too. This little time and money is nothing compared to your next few visits to your attorney's office when is time to renew that I am sure you're tired of doing.
I want to do it for my family, you do it for your family and then educate somebody else so they can go too. Next thing you know, we'll be a lot and we'll be heard.
If you don't go to D.C. you'll feel bad when you see that we succeeded and you did nothing about it!!!! just taking a "free ride" All of us are enjoying the results from the flower campaign and the S.J. rally. So we know we can do it again.
When you get your GC faster than expected, you'll feel so guilty.
We'll be there, I want to be proud that I did my part!!!!!

When I applied for EAD in NSC (paper file) it took 45 days to approve. Now I applied EAD for spouse on June 10th, no update so far.

I got a RFE on my 485 on 11th April and I have responded to it. By next week it would be 60 days by which USCIS has to take some decision. What would be the status update as my PD is Aug 2006.
