I have to admire the unbelievable energy and commitment of you guys. Especially those who organized the rally and to some extent those who attended it from far away are probably tired and catching their breath!
We need to have some creativity and strategy in our next step. Rally after rally probably is not the best way to get that, the so called law of diminishing returns. The flower protest for example gave us a lot of visibility and media coverage since it was something intriguing and new. It was fairly inexpensive and got us the kind of coverage we wanted and arguably results that were out of size with the effort.
I think we need to think outside the box and have one more high publicity event. Another rally is certainly an option for later should legislative action heat up. I'm hopeful the upcoming legislation will allow someone to introduce friendly legislation. I am sure IV's lobbying advisers will have some input on timing etc. and I am pretty sure organizations like compete America etc. also will use this to push their efforts as well. IV core ought to be in contact with them.

One thing I wish to add is that we must develop a good way of sending out many letters at will/as per the strategy of IV core to the lawmakers at critical times. We are 23K strong. Surely we can get atleast as many letters sent in to lawmakers at critical times. If you can't send a written petition to a lawmaker then I doubt it makes any sense to even think you or anyone can alter your fate, in that case time spent on sites like this is for what reason?
Professional organizations do letter campaigns all the time and get a good response. If everyone moves on these issues it does create a splash and can bring visibility and attention.

Hey guys,
if you look at Page 8 of I-131, USCIS says that if you filed I-485 after July 30,2007, then you don't need to pay the $305 fees.
Assuming one filed I-485 on 1st August 2007, will he/she be exempted from this fees? Anyone had been in such situation?
You do not have to pay fees, if you had filed your I-485 with the new fees. If you 485 was filed based on July 07 VB or earlier, then you still have to pay fees. The July fiasco as we all know, there are a extension till Aug 17 to file I-485 with the old fees, these applicants still have to pay fees for AP renewal even if filed between Aug 1 through 17

One change I noticed.
Now people can continue in the old system if the I-140 was approved or pending before the first day of the fiscal year subsequent to the the bill being enacted. So if the bill is passed right away, you need to have filed your I-140 before Oct 1 2007.

I attended the rally with my many of my friends from VA and MD.
I want to thanks this indian girl who attended the rally just to give company to her friend because her friend flew from new hampshire. She got her GC 2 years ago. After hearing this i felt happy for my decision to attend rally.

Well, it's time to break the news.:p I didn't attend the rally because
(1) the first and foremost reason: a recent surgey at my backbone , and I may not be able to walk for more than 15 minutes continuously.
(2) the second and honest opinion: Even If I were doing well, I wouldn't have attended the rally due to the yelling-nature of words from some of the Core leaders, and their pushy messages.
(3) the third and final point: The rally pictures and the rally experience of other members have impressed me very much and have totally changed my mind. So, next time, whereever you organize the rally, I will be there.:p
This is my honest opinion about my abscence. I hope noone will jump on me for my reasoning.

i have engaged with him more than once. he complains about someone or the other being rude on a non-stop basis. i would like to hear from him which core members has yelled and posted pushy messages. most of us desist from such actions most if not all of the time. actually he probably has no clue who core members are. after all it's not announced on the July 2 filers thread. in the past inskrish walked around with a red square to his name and accused me of being responsible for it. maybe he needs to see how many comments he gets in his user cp. interestingly enough i may be responsible for the green. this kind of passive aggressive behavior is not going to be of any help whatsoever to us.
i'm glad to hear he has a change of mind. but i will believe it when i see it. so far i see no change in the constantly complaining-accusing tone from him. words matter. constantly putting down others and acting superior is not constructive to an effort that is voluntary- each one of us- and certainly you franklin- have given up a lot to push this effort forward. words from the likes of inskrish do make me wonder why we bother.

Porting process is a legit process and for well qualified EB-3 india folks thats the only ray of Hope.
You can rant about it but noone going to stop the porting process becaue the folks who initially filed under EB-3 are now eligible to get Job promotions , new roles and responsibilities in their Career and in some cases new Sr. Job positions which are qualified EB-2. By the way they do file new PERM labor and new I-140, it is not a automatic qualification just based on number of years waiting in the endless EB-3 india queue.
Under the current circumstances where EB-3 india doesnt get any spillover numbers or any such relief like VISA recapture bill, do you expect them to go behind the lines with new EB-2 PD? What about the wait period in the backlog centres, in the PERM process and for few I140 stage waiting period? Its the law and people are following it. You can try porting to EB1 if you are qualified enough and port your EB-2 PD to EB-1.

I got approval email too. It cant be sheer luck that so many people are getting the approvals when it was taking 3 months as per their published processing times. Looks to me they just want to give 1 yr EAD to as many as possible. Good way to make money in recession year.
It was general observation that Paper Based EAD is getting approved very fast. We have quickest approval in only 18 days (http://immigrationvoice.org/forum/showthread.php?p=250677#post250677). And this was reported a month ago (on 05/23/2008).
So I think it is their speed - it has nothing to do with intention to give 1 year EAD. On the avarage, people are getting EAD in 25 days.
Myself went ahead with e-filing (this takes 50 days). My FP is scheduled after 5 weeks of notice date (http://immigrationvoice.org/forum/showthread.php?t=18737). For E-filing, they have different process,which has not changed in last two months.

AILA now feels defeated because they could not show themselves as the protector of this community. If you see the lawsuit text by AILF, it clearly asks for money for lawyer fees, but does not asks for moeny for Medical exam and mental agony. So if you are going to trust your lawyers to help you, then good luck.

Why file a lawsuit seeking injunctive relief to allow plaintiffs to file and at the same time demand reimbursement of medical fees and compensation for mental agony (I doubt if there were any plaintiffs put on anti-depressants or therapy in those two weeks as a result of the decision). You can't have your cake and eat it, you either win the case to enable filing, or you sue for damages incurred as a result of the decision but then you have to forget about contesting the ability to file, I'm sure any sane individual will be glad to choose the former and in this case thats what the lawsuit reflects. If you have ever read any class action lawsuit, the lawyers always ask for costs of the suit, this is normal even in non class action lawsuits, the loosing party pays the prevailing party's costs!
In the prior lawsuit that was lost, it is clear that Rajiv said recently that such cases against the executive branch of government need to filed in other federal court circuits other than the DC one where it is likely they will not be inclined to frown when deciding against the executive. I am not negating anyone's personal decision here but after leaving for 10 yrs in US and still not having a GC makes me wonder why I should go to canada rather I would go to india and live there where we spent our 25 yrs or so and be part of the community etc.
