Based on the posts in this forum,during POE the I-94 will say AOS pending status if you enter using AP..So i dont think it matters with AP validity date.

Can you use your spouse's cross-changeability after you have filed for your I-140 already ? How time consuming is this for the USCIS to acknowledge ?

i am quite sure you can...infact you can do this at any stage including after filing I-485.
please verify with an attorney...you will need one to do it correctly.

This might be little bit old, but I dont remember seeing a post on this. Employment-based immigrant visa fees almost doubled, Old fees $ 355, new fees $ 720 from July 13th. Does this mean USCIS will open the gates in Sept bulletin [to be released in August]?

New Consular Fees (http://travel.state.gov/news/news_5078.html)

Not applicable to most of us. You will pay $720 if you are doing your 485 through Consular Processing (I suppose).

My paper filed EAD ( and for my wife as well) has been pending since June 20th.

We called USCIS yesterday separately and both times they insisted that we needed biometrics and created SR for that.

Any one else had similar experience.?

Also I was trying to search for the Thread that has suggestions / steps to take to expedite the EAD. I think I'd qualify for severe financial hardhip since both of us will have to stop working if EaD doesnt come by October 18th.

Can some one point to that thread.

If PD is current when USCIS starts processing the applications, PD's doesn't matter. But if PDs retrogate (which will be the case most likely), then USCIS only going to process the applications which has PD current that time. I hope it makes sense.

My I 485 package was returned as it didnt have the approval notice of I 140, which was submitted a day later than I485 by my company.
It is such a frustrating situation as i have been waiting since 1999 for my GC , and when i got this golden chance my company was not serious enuf to submit the papers in time !
I am doubting the company , as they would have done all this intentionally to keep me in their co. for longer time!The returned letter they have provided me shows no reference no, file no, or either my name ! how can i believe if they have even submitted any papers for I485 or not ?
They say they can refile again .. but duno what to do ??
Can anybody be kind enough to help me out here!
I am so frustrated that I feel like going back to home country now.

HI All,

I have 3 questions

1)what should be the time period between the Job switch from one employer to another after 6 months of filing of I-485.(AC-21)

2)Is it required to be employed until i get my actual GC ?

3) I am in the period of AC-21 (i.e 180 days completed after my I-485 filing)
If I marry to GC holder . Do i still have to maintain my independent status of I-485 or i can be given some status because of marrying to him..

Hello,
1. I last entered US in Dec 2009 on H1B valid till Sep 2012.
2. Was laid off, changed my status to F1.
3. Got new employer, transferred my H1B to the new employer, got approval notice with no I 94 attached. My H1B visa stamping is valid till Sep 2012.
What are my options? Do I need new H1B visa stamping? Or just re enter with new I94?
