I've written time and again on the mission amnesia that afflicts federal immigration agencies. Following are my case details -
Visa and I94 expiration date: 12 Sep 2009
Filed extension: 11 Sep 2009
Extension denied: 18 Nov 2009
Left US: 15 Dec 2009
Refiled H1 Visa: 15 Dec 2009
Visa apporoved: 22 Dec 2009
What should my answer for following question in DS-156 as I left US within 30 days of receiving the denial letter?
Have you ever violated the terms of a U.S. visa, or been unlawfully present in, or deported from, the United States?
Kindly suggest.

YOU CAN. You have two options
You can interfile, the current 485 can be changed to approved 140 (eb3)
or
You can port the approved 140 priority date to the current 140 (eb2).

Guys I missed the conference call , But interested to know what happened &
if some key decisions made.
Called IV, But the person who answered was busy answering similar questions from other member.We don't want to waste precious time of IV leaders by calling indvidualy.
If someone who attended can summarize for the benifit of those who missed, It would be great.
Also does members of other nationalities(non Indians) also attended the conference call.. Hopefully IV is striving to become voice of all EB GC aspirants. Everyone will gain from joint effort and IV will have resources to do meaningful things.

Yes, you don't have to be in the US while the 485 is pending. You will need to be here for any appointments - fingerprinting, interview, etc. You also need to intend to be a permanent resident and work in the position listed on the I-140 (assuming this is an employment-based case). CIS might issue an RFE on the 485, asking for evidence of this, so you need to be able to provide it.

My I-140 & I-485 applications had been transferred to VSC for receipting and later my I-485 was transferred back to TSC. But my I-40 has been pending at VSC for close to 6 months with no signs of any processing. VSC seems to be still processing Apr 06 applications while TSC has been processing I-140 under 6 months. Realistically my application should have stayed at TSC, but was transferred to VSC due to receipting delays and balance the workload. But now my application is stuck at VSC. For no fault of mine, my applications ended up in VSC. There is no signs of PP starting anytime soon. Can I lodge a complain to ombudsman in this regard? Will they be able to help me? Who do I contact and where can I find all the information to lodge a complaint?

Thats correct. Once the I-140 is denied all the status' that comes with it goes away. So EAD, AP etc are no longer valid. Keep on extending H-1B and if the I-140 ever gets denied then you guys can move to H status.

Currently I�m holding h1 and same time has AOS with my existing employer. I�m continuing my employment based on h1 and use Advance parole for travel purpose. My employer mentioned about not revoking I-140, even if I move to new employer. Since with new client, I�m transferring my H1 visa, I have 2 options with regard to my AOS portability
1) Either just transfers my h1 without porting AOS with new client. Continue with my AOS with old employer, since he won�t revoke my I-140 and provide support for future employment.
2) H1 transfer and Porting my AOS with new client and it does require my job and description mentioned in I-140 matches with current offer.
I would really appreciate, if you provide your valuable suggestion/recommendation. The best option to go ahead with.

I am in pretty awkward situation. i have got my H1b Stamped in august 2008. Did not go to US because of the bad market situation and opted for woking in India. Now my current indian comapny wants me to travel to US on business visa( i have got B1 stamped in 2004 for 10 years) for 1-2 weeks.
Now i want to know , if i have both the visa stamped( H1b & B1), can i travel to US on business visa without affetcing my H1B visa because i am planning to go US whenever i hear that market is improving.
