    Apparently there are people who file for I-485 and I140 without labor approval.
    I don't know how many people did this, but I heard there are cases of this kind.

    What is the validity of this information? If it is valid, what are the risks?

    The person who informed me went further explaining the procedure. He said that one needs to just file and wait for further documentation request from CIS. Upon labor approval complete documentation is presented to CIS.

    Experienced souls, please advise.

    If we want to find out whether USCIS will accept our applications, we have to prove that Visa #s were available on a particular day. This thread will track the 485 approvals received on or after June 28th.

    Please add the following information for anyone you know who has got 485 approval on or after June 28th:
    1. Country of Birth
    2. Approval Date
    3. Category (EB2/3)
    4. PD

    Hi,
    Currently I am working for employer A on H1B. I have applied for I-485 and have EAD. I have one permanent opprtunity from a consulting firms B. Compnay B is asking me to join on EAD. But threir current client is in Canada. So compnay B want me to travel to Canada, every week, retun back to US in week end. Can I do this while working on EAD. I am just worried wether it will cause any problem. They told that that is the reason they do not want to do H1B.

    On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly. We have Free Trade Agreements with both Singapore and Chile which set aside 6,800 "H-1B1" numbers for nationals of those countries. Do the math: 65,000 minus 6,800 equals 58,200.     Hi
    My fiancee is currently on H1B (got through the 2008 quota) and I am currently on F1 visa status. She is planning to go on an F2 as my dependent.

    Please clarify these doubts:
    When she gets a job while she is on F2 and the new employer processes her H1B does she have to go through the whole process of H1B as a new visa issue (annual cap) or is it like an H1B transfer?

    Once going from H1B to F2, is there a certain time period one has to wait before one can go back to H1B?

    If the F2 application is pending, is it possible to reapply from F2 back to H1B?

    Any help will be greatly appreciated.

    Hi Friends,

    I'm working with employer A and my PERM labor got certified with employer B. My second H1B duration ends Sep 2011 (12 months) and I can recapture 5 months.

    1. Will I get 3 yrs of H1B extension if do the H1B transfer after my I-140 with employer B is approved.

    2. Will I get 2 years of H1B extension (09/2011 + 1 yr with approved Labor) if I do H1B transfer now?

    3. I went for a vacation and returned US just now. My employer A has generated pay stub only for a week and forgot to pay for the vacation. Is it Ok to submit partially paid last pay stub for the H1B transfer. FYI, I've all the other pay stubs for the previous months.

    It'll really helpful to decide based on the folks replies. Thanks alot for the help.

    Dear Sir/Madam,

    My h1b status (and I94) is valid till 20 Feb 2010. Few days back I have applied for my h1b extention on PP after completing 4 years 6 months. My I140 got rejected couple of months back and I appealed on it, It is on pending now. Basically i am looking for an options if my h1b extention gets denied , can i appeal for h1b extention and get h1b extention based my I140 appeal. Are there any other ways to continue to work in usa? or Do I need to leave usa immediatly? if yes with in how many days?

    Greatly appreciated your help regarding this. Please kindly help me regarding this.

    1. Can anyone tell me what all information about my green card status I need to share with prospective employer attorney to make sure they provide it in H1b application...???

    I am currently waiting on my 485 (EB2). My priority date is Sept 16 2005, and 485 date is Aug 27 2007. I have traveled out of the country and back on advance parole and am still on H1 as I am still with the same company. My current advance parole ends in Jan 31 2010. I have to travel again in the first week of Feb 2010. I applied for another advance parole at the TSC on Aug 31 2009 for both my Wife and I. My Wife got her parole in a week, but I am yet to receive it.

    I checked the USCIS site for the time frame and it says 3 months for TSC. I am thinking I might not have received it yet as I have a parole which is active. But I want to make the travel reservations now and I wanted a confirmed parole. USCIS said that they could put in an expedited request for the parole if it is an emergency. My lawyer says not to worry as I had applied in August, I had plenty of time to receive it.

    Please advice. What should I do.
