    I am working on L1B and also have H1B (without I94) from another employer
    I am filing L1B extension and H1B Change of Status at same time

    Situation 1) My L1B Extensions paper with (I94) comes prior to H1B change of status paper (with I94),
    which VISA will be applicable to me and my dependent spouse

    I think this should be termed "still bad news for most"

    Every with the opening up of priority dates, I would say that only a small minority will get a green card anytime soon!

    Back to work for us, the brief vacation was nice :)

    Don't forget, CIR took out most of the AC21 provisions...

    It is a security check as part of 485 processing where you are checked for a criminal background.

    Hi, I was wondering how long it is going to take me to get my citizenship. I received my permanent residency when I was 17. I was told I could have gotten my citizenship then but since I married a military personnel I wasn't sure if I was still eligible. Can I get my citizenship now because I received my "green card" under age or would I still have to wait 3 years being married to a U.S Citizen? Can I get my citizenship faster being married to a military personnel?

    Hi,

    The company I am working for is filing for GC.
    They have posted an ad,and all the mandatory work is done.
    HR up here have received some resumes for this ad.
    After reviewing these resumes, attroney says they may have to place a new ad, as they have recieved a resume which qualifies the position from a local person.


    I spoke to my manager and he says the same thing.He told me he did not even interview the local guy who applied.

    Is this the only way out of this position. Please advise.

    Hello,

    I 'm on H1-B visa already max out and got the extension for 7 th year based on perm pending.
    Petition is going to expire in Sep 2011 and last week my perm got denied.
    My employer is going to appeal for the perm and also going to apply H1B extension.

    Also I got an offer from other employer waited long time for this exiting offer. Not sure what are my options now , is it possible to take the new opportunity or should I stick with my current employer to deal with this issue?

    Looking for suggestions ASAP , thanks

    The Senate Homeland Security and Governmental Affairs Committee voted today to scrap the controversial REAL ID law which will require states to begin implementing tough new standardized technology requirements for drivers licenses in just a few months.     I was on H1 visa and laid off from job on 10/30/09. I got severance pay for Nov. and have the pay stubs. I applied for COS from H4 to F1 for my spouse (already in collage) and H1 to F2 for me on 12/9/09. Meanwhile immigration performed spot check at my ex-employers on 12/3/09, so they came to know that i was not working. My employer had not revoked H1 by then. Our COS application was received by USCIS on 12/14/2009, case is currently under Initial Review.
    - Will the immigration officers who did spot check inform USCIS that i was out of status?
    - Will case get rejected due to delay in applying for COS?
    - Will there be any complications in transferring my H1 to new employer as i was out of status for about a month before i applied for COS?
    - How to stop F2 COS if i get H1 transfer approved first?

    I was scheduled for Infopass today and found out the alien number assigned to my I-485 application is not the one mentioned in I-140 and belongs to somebody else in florida. I called NSC and they processed the service request and told me to wait for 45 days. I talked to NSC directly and without checking my application details, the officer tried to assure me that it is something that they will be able to fix when they will adjudicate my case. My EAD and fingerprinting were cleared under the wrong alien number and my lawyer told me that the alien number is assigned by USCIS. I will check my documents to find out if they did that mistake.

    Anyone else got in similar situation or know about someone with the same issue?

    Hello:

    I am on L1A at present and my full 7 year term is expiring in DEC-2012. My company could not file EB1-Int'l Executive or manager due to ownership changes etc. But they are considering EB2 and I was told that it will be risky as I would be required to convert to H1B before that and I would lose one year of stay.

    Can someone advise whether my company can apply for extension of my L1A beyond the 7 years, if it files for EB2 and would be pending for approval, instead of going through the issue of converting to H1B?

    hi,
    My company allows me to DIY my h1b renewal for my 2nd 3-year term of H1b. My title changed to SENIOR research engineer from research engineer last year. I have the same duty. When I fill out LCA/I129, which should I choose from:

    a. New employment:
    b. Continuation of previously approved employment without change with the same employer
    c. Change in previously approved employment
    d. New concurrent employment
    e. Change in employer
    f. Amended petition

    My wage is ok. Are there any potential problems or things I need to pay attention if I file my H1b extension with new title? or it is perfectly ok?

    When applying for the third stage you can include applications for spouse and children irrespective of the type of visa they are currently in.
