    Hi

    i am in a small problem and it would be great if someone could help me out.

    i came in us on f1 visa in jan2008 and i completed my mba in dec 2010. my opt expired on 31st march 2010. but before my SEVIS could expire i transfered my SEVIES to new college for summer term. now my visa is for 5 years ending on jan 2013. i know as long as i stay in US i am maintaining my status. but now i need to go home for few days. So how is it going to wrok for me? Do i need to go for new visa stamping or can i come back on same visa ? if i need to get new visa can i get it done in US before going home ? What are my option and what are my chances of coming back?

    I'm Australian and would like to return to the U.S. to visit in-laws with my partner but I overstayed my visa on my last visit.

    On my last visit, I received a 6-month visitor visa then extended my visa another 6 months. I overstayed my visa by 11 weeks; I was helping my same-sex partner move. This was two years ago. I did not work for anyone while in the States.

    What can I do if any to improve my chances of not getting turned away at Immigration?

    I think you have the wrong information. Senate is not ready to vote on it yet. S 2198 which is a part of PACE and holds relevance to the employment based immigration is still in committee hearings.

    I resigned my job last year on Dec 15th 2006 by giving my employer a 2 weeks notice (dec 29th was supposed to be the last working day). A week later, i informed my employer that i won't be leaving them at which time, he suggested that i continue working as normal and that he would take care of un-doing the paper work. They had sent out a letter to INS to revoke my 797 even before my last working day with them. The HR contact has failed to follow-up and inform the INS of this development and am told last week that i have been out of status for 10 days now (March 10 was the day INS revoked my H1b). The company has accepted responsibility for this mess and are filing an accelerated H1b (premium) application this week. I had continued employment this whole time and never had any break in my payments. Are there any chances the INS won't put be back on H1 status with my company ?.
    Experts .. please advice.

    I am an analyst under H1B and I am involved in a sales process by developing a prototype for a client. My company wants me to give a percentage of total deal as commission. It will show in the pay stub as commission. Is it legal to get commission under H1B (please remember I am a programmer analyst) ?

    On April 26, 2009 (Sunday), I had a LUD on my current H1. This seemed strange to me. Applied for 485/EAD/AP during July fiasco. My priority date is March, 2006 (EB2-India).

    Did anyone who is in similar situation as me have a LUD? Please ignore this post if this has been discussed earlier.

    This is related to the experience letter and PERM.

    I have been working with my current employer for last 3 years in software engineering role. Now I'm planning to move to program management role and planning to apply PERM from this new role.

    1. To get experience letter for PERM, can I use the experience gained in my current company. What are the chances of AUDIT if I do so?

    2. With my previous employer (3 yrs back) I worked in software and consulting role. Does this experience suffice for my PERM in program management role...Is it something the lawyer has to worry and not me..

    Any answers are appreciated..Thanks in advance for the reply.

    When you use EAD it does not matter if the company got any money under the TARP program or not.

    You should not even bring this to the attention to your HR. Go and use EAD as if the company is just any other company, make sure that the job is "same / similar" and get a lawyer for using AC21 portability.

    Hi,

    Is it true that the old (i.e., July 1st - July 29th) filing fees still apply through July 27th - August 17th? The new fees (which would have been applicable from July 30th) will now be applicable from August 18th, right?

    Is this true for I-485, I-765 and I-131 forms?

    I have a copy of Nolo Fiance and marriage Visas and in the section on I130 it says that my copies of G-325A must be filed in four copies printed on differently colored paper (white, green, pink and blue).

    A) Is this really necessary?
    B) If yes, I have actually bought paper in these colors. Does it have to a particular pink, blue, green etc?
    C) The pages in the PDF are actually named
    1) Ident.
    2) Rec. Br
    3) C.
    4) Consulate

    Which color matches which index? E.g. is the Ident one supposed to be white, blue, pink or green?

    Hope someone knows about this.

    I am stuck out side of US for my name check for last 9 months when I applied for H-1. I have approved I 140. is there any way I can file my I 1485 and Advance parole or any thing to get back into US.

    Some one has told me that I can use consular processing but have no idea about that.

    Please help me and let me know what are possible options for me to return to US.

    My details:

    India/EB3/PD:Sep2003/I140 Approved.
    I485/EAD/AP: Recevied July 28

    I completed FP appointment last week (Wednesday), but LUD has not changed since then.

    Also EAD status changed twice (before undergoing FP) it said Card Production Ordered. Today it changed to Approval Notice sent.

    Questions:

    1. Is there any relation between FP and EAD ? (e.g. Prints appear on EAD etc)
    2. Is that the right sequence in change of status:
    "Card Production Ordered" followed by "Approval Notice Sent".

    What is the difference been EB2 Vs EB2 NIW and when does one qualify for NIW

    National Interest Waiver means that you do not have to have a job to petition for EB-2 GC. Consequently, there is no labor certification requirement. NIW petition is your petition; not some employers.
