My wife couldn't get Xray on a failed TB skin test, because she was pregnant at the time we filed our 485. Our priority date will be current in August.

Should we wait for a RFE on her medicals? Or is it possible to go ahead and do it, and send an update to USCIS?

Marco Rubio has a challenge. He needs to appeal to conservatives in order to drum up enough votes to defeat popular Governor Charlie Crist in next year's Florida GOP primary. Then he has to run back to the middle to appeal to an increasingly liberal Florida general electorate. When it comes to immigration, he needs to come off as tough on illegally present workers. And then he somehow has to seem reasonable on the issue by the time he gets to the November election. The Miami Herald reports on how this is going to be a tough task.

I've been following this green card mess for the past 10 months and was well aware of it even while I was living back in Canada. Hi all. I'm looking for a little help with part 2 of I-485. I've sent off my I-140 and I am hoping to apply adjustment of status concurrently. I wondering which box to fill in part 2. A. looks the closest, it reads: 'an immigrant petition giving me an immediately available immigrant visa number has been approved. (Attach a copy of the approval notice......)' My trouble is this: If my I-140 is approved then my visa number is no problem, it is current for my category/country (outstanding professor/Canada). Since the I-140 is pending, this looks like the wrong box, however, none of the others look even remotely close. Any help would be greatly appreciated. Bark

I am a US Citizen and just married an immigrant. Her situation is interesting. Upon arrival to the U.S. she was detained and an I275 was filled out but not submitted. Apparently, her visa had been expired due to an overstay in the distant past. The result of the detention was a Paroled status stamped on her pasport. No I-94

We met shortly after her entry and are currently maried. We want to self-file the I485/I130 papers but don't know how to proceed without an I94 number. If we submit an I102 will she get an I94 replacement or will they reduse based upon her Paroled status, whcih she has overstayed?

Please Help...

Hi,

I had applied for 485 without EAD/AP since we wanted to file it on July 2nd. Still waiting for the receipt. Recently our lawyer sent the EAD/AP application based on the new rule, with just the FEDEX receipt confirmation of the 485 application. However, he sent the application to CA Service Center stating that based on the new direct filing rule, it can be sent to the local Service Center.

Is that right? Anyone with similar experience or insights. As far as I know it has to be sent to the same service center where we applied for 485 (NSC).

Any document or FAQ from USCIS that can clarify this issue?

This is not really a revelation as visa fraud has been a problem for decades at US consulates around the world. But it reminds us that there are bad actors out there and US consular officials have a tough job in trying to make sure that deserving applicants get visas while they ferret out the fraudsters. The $500 anti-fraud fee that accompanies every H-1B petition is supposed to help provide the funding to properly investigate and root out fraud. It sounds like the system is working.
