One of the comments on my post earlier today about the killed Border Patrol agent seemed pretty harsh - accusing most BP agents of being restrictionists with bad motives. I still think that's harsh and most Border Patrol agents are honestly out to do the necessary job of protecting our country's borders. If I apply for H1b in April, 2008 and choose consular visa processing, and the H1b starts in Oct, 2008. Do I have to go to the consular for a H1b visa? I might receive a EAD from 485 before October, and if I do, I would like to use EAD but keep the option of H1b open.

Can anyone answer me???

Say I don't activate my H1b in Oct 2008, but H1b is valid for three years, does it mean I can activate it any time by going to the consular for a H1b visa from 10/2008 to 09/2011? Of course I will keep my status valid (AOS) throughout the period.

Hi
I am currently on L2 visa with EAD and working for a company as direct employee. My wife is in L1. Both of our visas,I-94 and my EAD are valid till OCT-2010.

My wife has to go back to India as her current project is over.

My question is can a L2 visa holder with EAD stay back and continue working in U.S.A, after L1 has left the country ?.

Any information regarding this is highly appreciated.

1. what document's are needed to send to USCIS for AC 21 for/from company B.

Because of some reason or the other it happend to be so bad that my I140 documents were sent by courier on Tuesday - 17 July 2007.

can any one of you please suggest what best I can do to file my 485 during this current window July 17 to Aug 17 2007.

Interesting article....but no direct talk of H1-B or skilled worker immigration reforms etc.

The author of this article is Chris Isidore...I tried looking at the CNN site if there was a way of reaching him by email...but couldn't find any..

I applied GC labor in Mar 2005 and After 140 approval and 485 is pending morethan 2yrs, i changed my employer by using AC21. After that i recieved a letter from USCIS saying that I-485 denial on May 25th 2010, then after we applied on MTR on June 10th 2010. I recieved an reciept on June 20th 2010.

Can i work now by using an EAD or i need to wait until get the approval on MTR please do advice and when i could get the response from USCIS. My EAd is going to be expire within a couple of months, i applied renewal and i got a reciept on I-765. Please help me on this, really appreciate your help.

I am taking up a new job... The pay is good (10% more) and position is also of a senior lead developer.. I am not even leaving the area.. The company is 5 times bigger than my current one... I have an EAD card valid till Sept end 2008....What is your opinion. Should I go for the new offer? I am worried if anything will happen to my GC processing. Please help me make a decision.. I had applied EAD back in 2009.
I received my EAD which was valid from 06/02/2009 to 06/01/2010.
I had applied 485 back in August 6,2007.

So here are the questions:
1) Some of the instruction says, we should not pay for EAD application if we applied on or after 30 July 2007 though I applied in 2009 with application fee of $375.
Should I get back the above filling?

2) Why the EAD was issued for 1 year instead of 2 years for the first time?

3) If I apply now should I file with application fee? Because some instruction says that I donot have to send filing fee as this is a renewal.

4) Can I file electronically?

5) Should I file for EAD to Nebraska office where I filed 485 back in 2007?
