Hi,
I have received notice for I-485 FP, but my I-140 is still in process (not approved or anything). How is this possible? Is it because of concurrent filing?

yes, its normal and ok. Your 485 will be processed independently of your I-140, and your fingerprinting, namecheck etc will all keep happening. You just cant get it approved without getting the I-140 approved first. Everything else goes on in parallel.

It is advisable to file change of status to h4 while in USA, no need to go back to india. After you get your h4 approved then you can go for stamping...

Q. Will the payment I receive in 2008 reduce my 2008 refund or increase the amount I owe for 2008?
A. No, the Stimulus Payment will not reduce your refund or increase the amount you owe when you file your 2008 return.

Hi friends
I travelled out of USA and am trying to get back into USA with AP. I am using H1B(not stamped).
THey temporarily transferred to me indian office for this duration.
I also have EAD with me(not yet started to use).Now My co. is not letting me to go back to USA
without a project.If incase i want to change my employer, how can I do it..
Will it hurt to go back without employers permission to USA and then to use EAD to get a job?
After this I plan to submit my resignation.For EAD, 180 days already crossed.
If I want to do the above,how many days I have to get a job with EAD with a new employer after I go to USA?
What are my options?

My employer is planning to apply one for myself and was wondering if it's a good time to do so?
I've heard that DOL is blatantly denying a large % of applications that are in the audit queue. Is this true? :(

I am wondering what happens if I buy some real estate property ( a condo unit) while I am on H1B, and if i moved out of country, (H1B - 6Yrs completed) do i need to sell the property (condo) before i leave country? Can i rent this unit while i am away from country? On a new H1B can i come and stay in that home? Anybody experienced this case before? Please give me details as much as possible. Thanks.

My visa H1-B nd h4 visa was expired on june 30 2010. I have got an job offer and they filed my H1-B petition after july 20 2010. I have submitted my I140 and mine & my wife I485 applications in EB1 category on Feb 22 2010. The gap between the H1b process is nearly 20 days period. The USCIS has approved my H1 but my wife's H4 was denied.
Here is my question. Whether they would have kept the I-94 for me. How can we proceed with H4 denial situation. Please give me some suggesion

If you maintain residence here and continue to pay taxes, I think this is doable. You will have to ask USCIS for permission to stay out of the country for about three years.
