My law firm, Greenberg Traurig has been good too. Their immigration practice worked extremely hard to get the applications in-flight on Saturday. May be bcose they did not have 1000s of cases like other immigration law firms.

Most people showing their cool wisdom still not getting the point. A BEC person with Feb 2005 PD may not be able to file for another 2 years while a PD 2007 person will be enjoying EAD during that time. In my dictionary this is injustice. And that's why i was kinda happy when they updated the July bulletin, now I'm not really happy even if my company has already filed my 485/EAD on july 2. I'm still wishing (and i'll be honest) USCIS come up with a reason/regulation/rule that will delay EAD for everyone until BEC people are able to file 485 OR in Oct they retrogress only till March 2005.
P.S. if you are superstitious, you want to know this: most of my relatives/freinds call me "Black Tongue" because usually when i say something unpleasent it happens. e.g. i told my wife last month that i don't believe everyone is able to file 485, something will go wrong and everyone will be disappointed. (when everyone expects something it does not happen- contrarian theory)

Canada does not have 50 universities, in TOTAL. So your choice is limited to
(1) Queens University in Kingston, Ont.
(2) University of Toronto
(3) UBC
Well, that is not true. Canada does have 50 universities. Kingston, Toronto and Vancouver are not the only places in Canada. Besides many universities in Toronto area (McMaster, Toronto, Waterloo, York, Ryerson) other Provinces such as Alberta, Saskatchwan, Manitoba, Quebec, New Brunswick, New Foundland, etc. all have good universities. If you are a PR, tuition is very low compared to the US. If you are outstanding in your field, you can hope for a grant too.

I have got an RFE for 485 application. USCIS is asking me for Employment Letter, Paystubs and W2 for the employer I NEVER worked. (I have typed exact message below)

Then I started working with 'Employer #2' from Jan-2005 to present. Employer #2 filed my H1/Labor/140/485. I am still working for Employer #2

However, I thought of changing job in 2006 and 'Employer X' offered me a job and sponsored my H1 and it got approved too, but I changed my mind and decided to continue with my current employer (Employer #2) and I am still with Employer #2. Ask your attorney to write a letter in response to RFE and explaining the situation you never took the job with employer X though the H1B transfer or new is approved, this will clear the query of USCIS. One catch, you should have maintained a continuous employment with #2 and demonstrate the same to USCIS. Good luck!
Note H1 to L1, H4 to H1, L1 to H1 is completely different, it is change of status - H1 to H1 is not change of status, so there is no question that you recent h1 is valid and past is invalid. Get an attorney, Good weekend

This is another example where lot of noise made and then nothing happens.
People talk here about filing lawsuit as it it is easy as filing something and on first hearing, judgment will be passed in their favor. Of course, no one even bothers to get initial professional advice.
Soon, we will have some other topic that will have similar discussion and similar fate.

Skills in general are typically formed by three components:
a) 1/3 - Formal hands-on Training
b) 1/3 - On the job experience
c) 1/3 - Reading, research on your own
If you have some indirect project experience by working as a programmer for example, I don't see why not you cannot do items a) and c) above. At least the PMP (or whatever certification you intend to take) will be ready when opportunities come and the training should help you expand your horizons. Good luck.

And in many cases, the best person is already here, and has gathered more experience over the years working for US companies.
But they cannot hire her, simply because she is on a visa and thereby beholden to another company. If she had a GC, that would free up the talent pool and thereby make many companies less reliant on H1Bs.

Last year also it came to 2006 but again retrogressed..
But this time.. i don't know.. i am hopeful..

Well. It certainly is a good news. Atleast for me. :) I would like to caution though that getting current does not necessarily mean getting approved. We have had cases from 2003/2004 PD members where they did not get approved for long time despite their date getting current.
Last year also it came to 2006 but again retrogressed..
But this time.. i don't know.. i am hopeful..

I read in some posts before that there were 18,000 Eb3 approvals in 2007. Is this true ? If USCIS is allocating unused numbers at the end of the year, then Eb3 India might move fast during the rest of this year.

Every airlines has its onw set of issues - u will get the pinch only when shit hits the fan. My bags were stranded in Dubai and when I reached Chennai I had nothing with me except a small bag with no clothes.
The agents told me - if you have Indian passport then Emirates will give you $$ compensation per day but if you have American passport Emirates will give $$$ per day. They reimbursed me for 2 sets of clothes and shoes and $50 per day for three days because my bags arrived one by one on the third and fourth day after calling them everyday and pressurising them. If we did not call them - the bags would come slower than that. In Dubai the bags were in hot sun and I had choclates inside and somehow the cover broke and choclates melted and seeped through and a I think you all can imagine how it is.
What I am saying is - things are good everywhere unless we get into issues. Things were good until Retrogression hit us here. Now we complain about difference in treatment - but earlier wenever complained.
What I am saying is - when dealing with things outside of your home country - you cannot expect or assume fairness to you.
I would submit that this is far more discriminatory than Air France or any other airline flying via Europe. The European carriers are bogged down by their country's immigration policies, it seems. I flew Air India via Frankfurt once and the German security officials had all Indian passport holders (not possessing a Schengen or transit visa) quarantined in a separate holding area with inadequate seating and restrooms for the hour-and-a-half layover. I can imagine the frustration that would have ensued had there been longer delays.
However, unequal compensation for troubles caused by the airline is entirely a different and unacceptable matter. It is discriminatory and I'm sure it violates some international mandate somewhere.
I disagree that because you are outside your country, you cannot expect to be treated fairly. Unless they have a solid evidence that you have broken a law, they should not treat you any different than any other person.

my gc process started in october 2001 but i have a PD of Jan 2003.
they are slow but they're good.
It depends on which office of Fragomen you are dealing with or should I say which attorney. One of the attorneys in DC office took 8-9 months to file my labor.

No. What I am saying is that this is a good amendment that can help us. But if its introduced and voted upon, it will fail to pass in the Senate because this amendment has a H1B exemption and H1B quota increases are very very unpopular and controvertial since last few years.
Therefore the achilles heel (Weak portion that will cause failure) of this good amendment is the H1B quota trick attached at the end. The amendment may pass the senate with a majority vote if it doesnt have H1B quota exemptions in it.

The placement statistics from the Rotman school of Management website is quite impressive.
I've a few questions for you. How bright are the job prospects after doing an MBA from U of T in the current recession wolrd? Are part-time MBA students given equal opportunity in job placements? What's the % of placement among Canadian vs US employers?. Howmuch salary can a person with Engineering degree + US experience + Canadian MBA expect to get?

Compared to Canada, US literally treats foreign students like dogs....I dont understand why people from India still come to do MS in US. Yes I know I have done MS in US and MBA in Canada....so I can compare first hand.
Let me be honest. Opportunities in Canada is no way compared to US for a US Citizen/GC.
However if you are not a US Citizen/GC then you are far better off in Canada.
Lately Rotman is a bit too expensive for non-resident tuition. So I wont recommend that to international students. However you can choose U of Calgary etc. I was a PR before I joined Rotman so I got loans, worked part more than 20 hrs week (often more than 30 hrs). Leaving H1B job in US for a MBA in Canada was one of the best decisions I have taken. In fact I was so convinced that I should not do MBA in US that I didnt even apply in
US schools.

Based on the various discussions in this forum, the number is expected to be around 20k. No concrete evidence for this claim.
It will be interesting to see Sep bulletin. Because at present except EB2 I & C all other categories are either C or U. So, each and every visa will go to EB2 I & C and there will be plethora of approvals beginning Aug 1st. I-485 processing date is in July ’07 (both at TSC and NSC) and all the pending EB2 (till June 1st 06) may not be ready to adjudicated (RFE, denials, I-140 not cleared etc). If the above numbers are correct and given the fact that additional numbers will be available beginning Oct (2008 quota), there is bright chance that EB2 dates may still move further. This is my personal opinion.
Does any one has any Idea or back of the envelope calculation as to how many EB2 visas (for all countries) may be left for the remainder of FY'07?
The reason I am saying Eb2 all and not EB2 India, as most of the 485 applications filled in early July 485 were from India. Hence, given the new interpretation of visa overflow, almost all will be assigned to this category.

Sent 2 letters for self and wife..have asked a couple more friends...sent email to local senator , will follow up with a letter also..
