Good to hear some good and not so good reviews about the immigration lawyers in this thread. One of the firms about which folks have written contradictory statements is Fragomen. Thay have been very responsive and professional in some cases but the user polulation in general has complained about their non responsiveness. They have advised their clients ( i.e the companies) about how the slow down the process for green cards for their employees. It has been seen in a multitude of cases that they have advised the companies of not filing for EB-2 cases and use the route that creates the most delays in GC processing thus maximing the revenues for themselves and helping the companies use GC processing as a tool for employee retention. They made employers to belive that letting the cases processed in BEC is the best option instead of capturing the PD's from the old cases to PERM. Now, several thousand of those cases are still languishing at BEC and no one seems to have an answer about what will happen to those after 17th August.Isn't that so so unfair......
Their practice can not be termed ethical and the employees need to highlight this issue with their senior management and HR. I was wondering if Immigration Voice can help those individuals by guiding them about appropriate steps to highlight the malpractice by Fragomen.

Well it would be easier to work with Oracle, Microsoft etc and get their support and provide your support to them.
Get support from whom? The same corporations that want to outsource jobs to low cost countries AND also lobby for H1B increase, again to keep wages low and all this to increase their bottom line. We need to re think our strategy and get it straight as to who is on our side and who is not.

Wow....let me share this with you: USCIS doesn't make up these rules; it stems from a US Law called DOMA - Defense of Marriage Act which only offers the 1,152 federal benefits of marriage to hetersexual couples.

Securing America�s Borders
It�s a national-security issue.

America needs secure borders. Right now, we don't have them. Every day thousands of people violate our frontiers. We don't know their identities and, quite often, we can't stop them. As a nation of immigrants who honor the rule of law, we must secure our borders before we can reform our immigration policies.
That's why I introduced the Securing America's Borders Act Thursday night. The bill will take our first step towards a safer and more secure border. This new law will add resources to border protection; give our immigration-enforcement officials new legal tools; invest in barriers; and make it easier for employers ensure that they hire only citizens and legal residents. In short, it will make border security a key component of our national-security plans.
Enhanced border protection starts with additional people and equipment along our frontiers. While the Senate last year led an effort add new border-patrol agents to the President's budget, a single action can't solve a longstanding agent shortage. Over the next six years all told, my bill will add nearly 15,000 additional border protection professionals to augment the 20,000 Customs and Border Protection agents already on the job. To make sure that all CBP officers benefit from the best available technology, furthermore, my bill provides for new investments in aerial vehicles, cameras, and sensors. To give CBP's work purpose, it will also establish a tough, thoughtful, and comprehensive national border-security strategy.
So that DHS officials can catch those who violate our borders, my bill will also enhance collection of biometric data about border crossers while creating tough new penalties for human smugglers, people who forge border-crossing documents, and those who involve themselves in sham marriages. Finally, terrorists and members of dangerous gangs will face expedited removal from the United States.
Prevention also matters. We can nip security challenges at the bud and save lives if we prevent people from breaking our immigration laws in the first place. Each year, many people die trying to cross our border. I've already asked the Government Accountability Office to investigate the deaths along the border but I don't believe we can wait for study results. Thus, my bill will also begin the process of building a 1,951-mile long virtual barrier across every inch of our border with Mexico. The new barrier will combine walls and fences in high-traffic areas with sensors to let CBP see and hear those who make a run for it in low traffic areas. Together, these measures should make the border safer and more secure.
Enforcing immigration laws with regard to those who enter the country, however, will only do so much to enhance our national security. Most of the people enter America illegally, after all, come here to work. Nearly everyone agrees that employers should have some responsibility for making sure their employees have legal clearance to take and keep their jobs. Right now, even the most well-intentioned employers lack a quick, efficient, foolproof way to verify the immigration status of the people they hire. Thus, my bill will expand an existing pilot program into a full-fledged electronic employer-verification database to help employers and workers alike.
While these proposals provide a good starting point, we still need to do more. Among other things, the full Senate will need to address ways we can balance security interests with our economy's labor needs and the role National Guard units might play in border enforcement. In the long term, our government needs to work on policies that encourage democracy and prosperity abroad which will also address our immigration crisis by reducing the number of people who feel that coming to the United States is their only option.
We are a nation of immigrants and that heritage remains strong in our hearts. Every immigration- and border-related policy the Senate approves must contribute to our country's security. Only a focus on security that emphasizes the rule of law will make our nation safer for all those who live here and who come here.

I just went through the number of members in the IV org. To my surprise I found 21,353 members. If atleast each of the member contribute atleast $5, we could easily hit above $100,000. But I am sure we all can contribute far more than $5.
What a shame that the educated highly qualified H1B holders who haven't contributed anything so far don't get it. Come on guys/girls contribute in some way...come to the rally or sponsor someone if you can't make it or atleast contribute some money. You don't want to feel guilty all throughout your life thinking you were just a free-rider.
Take advantage of this great opportunity, BECAUSE OPPORTUNITY LOST IS LOST FOREVER. IT SELDOM KNOCKS TWICE.

If you guys read the letter a bit carefully, it says they do not have information about the country of chargeability and they cannot share it with us. For $5K all we can get is a breakdown of how many apps are there in each category and then it will be a guessing game of how many are pending for applicants from India/China/ROW etc. Just something to keep in mind.

IMO we should first try to form a local chapter. If that doesn't work try to combine forces with nearby states like IN, OH, IL etc. to form "Mid West" Chapter ( like New England and Tri-Sate Chapters).
Co-ordination with IL chapter will be critical for us (and others too) in the coming days as Mr. "anti-legal immigration" Durbin is the senator there. We need to start acting - NOW - to convince him to drop anti-immigrant measures such as "barring H1Bs from consulting business"; instead of waiting on him to introduce his "Prevention of H1 & L1 Fraud Act" (and discuss it on IV ad nauseam without making the slightest impact)
Someone suggested even joining the illinois chapter - maybe thats the way to if there aren't many here

I have no idea how you guys can even generalize something like this.
IT is vast; the spectrum vertically ranging from Networking, to Programming to Front end design and horizontally ranging from web based apps to system apps to distributed apps to enterprise front-ends.
I have seen guys in our field come to work with double masters, 11 years of very relevant experience and still struggle to grasp the intricacies of what we do.
As they say, when you know too much it is then that you realize how less you know.
If you think your job (read coding "hello world" for clients) can be done by somebody with lesser qualifications, you/your employer has committed an immigration fraud.
even though I am in EB2..from my personal experience, the kind of IT contracts/jobs/assignments we (most of us) do, I dont think there is anything that an EB2 qualified can do which EB3 cannot do.
I saw threads (this site or elsewhere) where EB2 ppl felt superior and blasted the threads where EB3-EB2 conversions were discussed.
IMHO, I would always say, if it is legal and possible and beneficial, ppl should think of conversion.

Yes that is true. They are lobbying strongly for H1b though they are supporting GC increases. Actually with H1b you can stay unlimited years if you apply gc. So there is no urgency for corporations to resolve the issue. They do not have fear of losing you as you are going to stay in USA until you get green card
I don't think the tech companies are lobbying (strongly enough, if at all) for EB GCs. They are happy as long as H1 quota is increased which I think they will get in one form or the other.

I agree with you, there are enough people who do h1b bashing really well, we are here to fight a cause let us do that right.
We do NOT support H1b increase without first reforming the EBsystem - we are neutral on this issue. There is nothing for us to gain by either supporting or opposing H1-b increase. We cannot support it because it worsens retrogression. We cannot oppose it for the simple reason that we are ourselves on H1-B. If someone thinks H1-B is bad, then how on earth can you justify giving GCs to these H1-Bs ? Why don't we start by deporting ourselves then ?
The reason zazona and numbers USA are "successful" is simply because they are citizens groups - and they have a sympathetic audience of folks who lost their jobs, as well as sympathetic mouthpieces like Lou FOULMOUTH. Politicians are bound to give weightage to these people's concerns (valid or not) if they wish to remain in power.
Lets leave H1-B bashing as an exercise to the zazona,foulmouth and co. We have scarce resources to begin with as it is, and they are best spent on something constuctive.Unfortunately, we do not seem to have any shortage of ideas on what new items IV should be working on.
