The ability to transfer priority dates from an earlier, approved, I-140 to a later-filed I-140 could provide an alternative for job mobility, both within the current employer's organization or with a new employer. This would be helpful for those who want to make a change but are not eligible to file the I-485 application because of retrogression. It also could help people who are eligible to change from an EB3 classification to EB2. One would be eligible to request a transfer of the priority date from the earlier-filed EB3 petition to a new EB2 petition once the I-140 is approved. The new EB2 petition would need to be based upon a new LC for a position requiring the EB2 level of education and/or experience. (Over time, many people with EB3 cases have become eligible for EB2 cases due to increased experience and/or education, and promotions.)
This strategy potentially could shave off a few years in the queue for available immigrant visa numbers. This may be particularly appealing to those who had EB3 labor certifications filed on their behalf long ago and have had their cases pending while they have gained advanced degrees, acquired several more years of experience, and/or are offered jobs at higher levels. Berry Appleman really sucks. Dont ever go there.
I gave all my signed I485/G28/I325/I765/I131/693/Photos forms by June 8th. They filed mine on June 27th. They reviewed it for 17 days.
They never attend email or calls. Hope mine gets accepted.
I don't think Berry Appleman is a good firm, they took 30 days for all people to prepare simple docs for I 485 which takes 2 hours for us to prepare and they never respond to calls and email.

Is there anyway we could go about pushing our story in the media? I am sure all of us combined have a a few thousand bachelor's, master's and ph.d. degrees. We are a group of people with highly advanced skill sets and this needs to be advertised. Maybe convincing a few journalists to take up our cause could be an option. Local newspapers, political blogs, radio stations etc. etc.

I have a last pay check through an Employer A of August 1, 2008. Earlier before leaving Employer A I filed a H1 transfer to a new employer B and that got approved by USCIS but I didn't start working with Employer B. Now I am getting a new offer from Employer C which is better than Employer B. Attorney of Employer C says that he can file for a transfer through company A as the pay check is less than two weeks.
Now my problem is I not sure whether my transfer from A to C would be successfull or not?
Another thing I have not informed Employer B that I will not be joining him, Do I have to pay him all the H1 transfer fees?

Why can't we move from a free service to a membership based and see how many people still continue ... evenif with 25K members it is only a handful who are active and part of the initiative ... so I would suggest to go for a membership ...
it could be a per month basis or pay a big amount and get membership for life or year ... say $200 for a year or $20 for a month ... we don't need the number/mass unless they are active in all way ... just my thoughts ... hope the IV core team will consider that ... enough of free rides ... now pay for it and get the access to forums ... :mad:

It seems like the group I am currently working in will shutdown in few months and more than half of the people have left the group already. I, therefore, need to find a job in next 4 months or so. I am a computer engineer by profession but trying to pursue a career in SAP functional field or DBA and looking for some advise from professionals in the field on training requirements/opportunities, career opportunities in different SAP modules, and how to basically get started.

I am in EB2 ADP with PD Feb'09. No cheating there ! :)
I understand that if a lot of EB3 guys, who have been waiting for years, start porting to EB2, they will end up in the queue before me :(. And with that knowledge, I will still support EB3-EB2 porting.
EB3 guys, porting is your best option. I hear a lot of EB2 asking you to go get a new job where they are willing to
a. Hire you with your H1B status,
b. Agree to file your GC, and
c. Agree to do it in EB2 category. (Think about the min wage they have to give and prove etc.)
It is way easier said than done in the current economy. But if you find one, go for it. That is a way of respite for you folks. For others, try porting to EB2 with your current company.
There have been cases where EB3 was filed when the candidate was eligible for EB2 and there have been cases other way round too. But talking about none of them helps your cause. Similarly, fighting amongst us doesn't help either. Don't get me wrong if I say that with EB2 movement, if EB2 becomes current by the end of next year, EB3 will start seeing a good benefit of spill overs. So with current laws, getting EB2 out of the way will actually help your cause
Eliminating per country limit will help everyone. We should fight for that, EB3 and EB2 together.
Seriously try for porting. I have been waiting just a year, and already know how many decisions get put on hold because of this process.

And most people on this forum who rail against the treatment of Indians might want to think about why they left India in the first place. India is by and large an extremely unfair place to live. There is constant discrimination. We left because we wanted to lead a decent life without pandering to someone all the time. Everyone from India on this forum was fortunate enough to be educated enough that they could afford to make that choice. There are a billion people who can't make that choice. And they are in India. We chose to abandon them and come live among what we percieved to be a fairer society. And it is, in a lot of ways. Do not be hasty to judge through the glasses of pent-up frustration about your current circumstance. If you have a personal experience that you thought was not fair, tell them at that moment why it's not cool. And by and large, they will stop or at least empathize with you. Try that back in India - tell your local politician why you think he's not doing a good job and see how well that goes.

I have been thinking about whether to attend the rally or not from past few weeks. Attending the rally would require me to take a day off. Finally today without thinking twice I just went to my manager asked if I can take day off on 9/18 instead compensate the work in the following saturday. It was approved and I am attending the rally on 9/18!
I am feeling so good now.
Also, I live in DC area and can help if somebody needs to be picked from airport to the rally and drop them back if needed.
Hope to see thousands on 9/18th...

They will think of themselves only. Characteristics of such peoiple are: Selfish
Instead of celebrating the greater good for all, they are just worried about what they are getting out of it.
These people join a group for security; but will always think only about themselves and will take every opportunity to demoralize the whole team.
We know BEC is an issue and there is sympathy for them, but does it mean we want to stop 700K people with families not getting a chance to better their lives
